Acte de violation des règles de gestion des finances publiques par toute personne fonctionnaire ou non, employé ou mandataire d'une administration publique. Les fautes de gestion sanctionnables par la juridiction des comptes sont constituées, entre autres par :
- le non-respect des règles d’exécution des recettes et des dépenses ou des règles de gestion des biens publics (ex. engagement sans visa préalable du contrôleur financier );
- la couverture hiérarchique de l’acte constitutif de l’infraction (les gestionnaires peuvent être sanctionnés pour les fautes commises par leurs subordonnés) ;
- l'inexécution des décisions de justice ;
- la violation des règles fiscales ;
